Article 1 – Purpose
These general terms and conditions of sale (hereinafter “GTC”) define the rights and obligations of the parties within the framework of remote booking of accommodation services offered by the Hotel Le Fayard, a company whose registered office is located at 15 rue Simon Vialet, 07240 Vernoux-en-Vivarais (SIRET: 49249858900026). They govern all the steps necessary for booking and its follow-up between the parties. The customer acknowledges having read and accepted these GTC, as well as the specific conditions of the reserved rate, accessible on our online booking platform. These GTC apply exclusively to bookings made via our website.
Article 2 – Booking
The customer selects the services offered on our booking platform. The customer acknowledges having reviewed the nature, destination, and available booking options, and having obtained all the necessary information to make an informed booking. The customer is solely responsible for choosing the services and ensuring their suitability for their needs. The booking is considered accepted by the customer upon completion of the online booking process. All bookings are nominative and cannot be transferred to a third party, whether free of charge or for payment. Article 3 – Booking Process: Bookings are made via the online booking form. The booking is considered confirmed upon receipt of the booking confirmation. The customer agrees to accurately complete the requested information and attests to its truthfulness. The booking procedure includes: entering bank details as a guarantee or prepayment depending on the chosen rate, reviewing and accepting these General Terms and Conditions and the conditions of the reserved rate, and then confirming the booking.
Article 4 – Booking Confirmation
A confirmation email is sent without delay to the address provided by the customer. This email summarizes: the services booked, the prices including VAT, the terms and conditions of sale for the selected rate, the booking date, and the hotel's contact details (address, telephone, email) allowing the customer to submit any complaints.
Article 5 – Cancellation or Modification by the Customer
In accordance with Article L. 221-28 12° of the French Consumer Code, the customer does not have the right of withdrawal provided for in Article L. 121-21 of the same code. The following cancellation conditions apply:
Flexible Rate
• Free cancellation up to 72 hours before the scheduled arrival date.
• In case of cancellation within 72 hours of arrival, 50% of the total cost of the stay will be charged to the credit card provided as a guarantee.
• This rate is guaranteed by a credit card authorization. No charge is made at the time of booking; Payment is made on site.
Non-Refundable Rate
• Full payment for the stay is debited at the time of booking.
• This rate cannot be cancelled or modified. Payments made are non-refundable under any circumstances.
• In return, this rate benefits from a 10% discount compared to the Flexible rate.
No-Show
In the event of a no-show without prior cancellation for a reservation guaranteed by credit card, the hotel reserves the right to charge the amount corresponding to one night as a fixed compensation fee.
Article 6 – Consumption of Services
In accordance with current regulations, upon arrival, the client may be asked to present identification and complete a police registration form. Any behavior contrary to public decency or order will lead the establishment to ask the client to leave the premises, without reimbursement of any sums already paid.
Article 7 – Prices
The prices displayed are in euros including VAT. They are valid for the period indicated on the booking platform and include VAT applicable on the date of the order. Any change in the VAT rate will be automatically reflected.
The tourist tax, if applicable, is payable directly on site. Additional services (bar, breakfast, snacks) are not included in the room price unless otherwise stated at the time of booking.
Article 8 – Payment
Hotel Le Fayard accepts the following payment methods:
• Credit card (Visa, Mastercard) – secure payment via Elloha/Stripe
• Cash (on site only)
For the Flexible rate, the credit card is registered as a guarantee only – no charge is made at the time of booking. For the Non-Refundable rate, the total amount is charged at the time of booking. Card validity is verified by Stripe. In case of refusal, the customer is asked to contact their bank and confirm their reservation with the hotel.
Article 9 – Liability
Hotel Le Fayard cannot be held liable for the non-performance or improper performance of a reservation in the event of force majeure, actions of a third party or the customer, including but not limited to internet network unavailability, external intrusion, or a computer virus. Any irregular or fraudulent payment attributable to the client will result in the cancellation of the reservation, without prejudice to any civil or criminal action.
Article 10 – Complaints
Any complaint relating to the performance of the services booked must be sent in writing to the hotel within fourteen (14) days of the departure date, under penalty of forfeiture, to the following address: contact@hotelfayard.com or by mail to 15 rue Simon Vialet, 07240 Vernoux-en-Vivarais.
Article 11 – Protection of Personal Data
The personal data collected during the booking process is intended for the Hotel Le Fayard, Elloha, and its service providers (including Stripe for payment). In accordance with the GDPR and the French Data Protection Act, the customer has the right to access, rectify, and delete their data by contacting the hotel at contact@hotelfayard.com. Bank details are transmitted securely via Stripe and are not stored by the hotel.
Article 12 – Evidence Agreement
Entering bank details and accepting these Terms and Conditions constitutes an electronic signature with the same legal value as a handwritten signature. The computer records kept by Elloha are considered proof of communications, reservations, and payments.
The customer's IP address is recorded at the time of booking.Article 13 – Force Majeure
Force majeure is defined as any external, unforeseeable, and irresistible event preventing either party from fulfilling all or part of its obligations. Each party is released from its obligations in the event of force majeure, as recognized by French case law. Each party shall bear its own costs arising therefrom.
Article 14 – Dispute Resolution
These Terms and Conditions are governed by French law. In the event of a dispute, the customer is encouraged to contact the hotel first to attempt an amicable resolution. If this fails, the parties may resort to a consumer mediator. The mandatory consumer protection provisions applicable in the customer's country of residence remain applicable.
Article 15 – Entire Agreement and Amendments
These General Terms and Conditions, the specific conditions of the reserved rate, and the booking confirmation constitute the entire agreement between the parties. In case of conflict, the provisions of the booking confirmation shall prevail. Hotel Le Fayard reserves the right to amend these General Terms and Conditions at any time. The version in effect is the one published on the booking platform at the time of booking.
